| Hereford & Worcester County Council Records, England The entry in the Quarter Sessions Order Book, page 379 on 14-16 January 1828 states; "Ordered that Francis Barr and George Britton who have been indited and tried for stealing six pounds weight of horse hair of the value of ten shillings and one leather whip lash of the value of six pence, the property of John Partington and found guilty of each. Transportation to some or one of His Majesties Plantations beyond the .... .. His Majesty with the evidence of his Privy Council show direct for the term of seven years." "Ordered that the Treasurer of the County .... do forthwith pay or cause to be paid to the said John Partington the sum of ten pounds nineteen shillings and sixpence for and towards his costs and expenses in the above prosecution. |

| Australian Convict Records(1) Francis was tried at Worchester on 14th January 1828 for stealing a hare and sentenced for 7 years, to be served as a government servant under the employment of John Pike Pickering, Hunter River, N.S.W. He had no former convictions, was a Protestant, married, could read and was a ploughman/shepherd. Francis was 20 years of age, 5 ft 5 3/4 ins tall with a fresh complexion, brown hair, hazel eyes and had a small scar on his upper lip. Francis arrived in Australia on the 12th October 1828 on board the convict ship "Marquis of Hastings". After serving 21 years ? Francis finally received his ticket of leave on or before 1849 (yet to be confirmed). The 1841 Hunter Valley Directory does not list either Francis or his employer John Pike Pickering. The "Marquis of Hasting" was built in London in 1819 and was a Class A1 ship of 452 tones. On the voyage in 1828 Jn. Jeffrey Drake was the master and William Rae the surgeon. The ship departed London on the 30th June 1828 with 178 male English convicts, sailing via Teneriffe, in the Canary Islands and taking a total of 104 days. The day after arrival in Sydney the Colonial Secretary, Alan McLeay reported 175 healthy men and 3 in hospital. The "Marquis of Hastings" made 2 voyages between 1821 and 1828 in under 110 days from England to Australia. |

| Australian Convict Records(2) Francis served his full term of 7 years being given his Certificate of Freedom (No 35/428 - Prisoner No 28/1822) on 23rd April 1835, during which he had grown 2 inches as it was stated on his certificate that he was 5ft 7 3/4 inches in height. On his release Francis had a balance of 20/-, made up of; an Savings Bank Ledger 10/- and Convict Ledger 10/-. At the time (1833-1871) interest was calculated at the rate of 5% PA. |
